  To burn or not to burn

I apologize in advance for reopening this thread. Maybe you all won’t take it up again as I’ve become aware it’s been done (to death?) before. But I can’t go to sleep tonight without spewing a few of these thoughts. Doing something like that at night is not recommended, and one often regrets it in the morning… but I’m still young! Sort of….
I want to address the issue of burning an OUT OF PRINT cd for someone who does not have a way to purchase it. Imagine a pimply-faced 17 year old teen who, in 2002, hears of this great old cd called Outdoor Elvis by a side project that his new favorite singer/songwriter, Terry Taylor, once had a hand in. He goes to Northwestern bookstore where they don’t even have it on records as ever having existed. He goes to Ebay and, great, there it is. But it’s at $40 and he just can’t afford that. He can’t find it new, he can’t find it used, and he doesn’t know of anyone who has it.
Should he not be able to get a burned copy from someone so he cat at least listen to this wonderful record? Can he not go Driving in England? Will he never hear the calculated existential angst of Cocoa the Talking Guitar? How will he be able to yodel along with Arthur Fhardy? (Don’t claim you haven’t!) He won’t be able to hear the tender (and sincere!) ode to Billy Graham by Terry and the late Gene Eugene. He won’t learn the end to the eternal question of what will happen to the Band that Won’t Go Away.
Even if he does find it used somewhere, tape or CD, the band will not profit from his purchase (right?) I just think it is silly to keep wonderful, energetic, creative, funny, crazy, thoughtful, provocative, satirical, cunning, brilliant music by DA/Swirling Eddies (or any other band with OOP cd’s) from the hands of eager listeners just because they don’t even have the option of buying it. Let them have their cake. Let them eat it. And let them not be forced to hide it when the pastor shows up.

P.S. I was that pimply-faced 17 year old in 1989 when I bought my cassette copy of Outdoor Elvis. It thrilled me. It got me through high school. It gave me an insight into Christian thinking I would one day have (“Hide the Beer…,” “Knee Jerk,” “Driving in England,” and many others). I’m glad it could be a part of my life, and now I’m glad to have it in digital clarity from a kind Internet friend.

I don't think anyone connected with DA or the Eddies would complain about a CDR being made of an out-of-print album for a friend. It's good when the fans have access to those out of print albums. At least until we can make them available here in the store... Wink

They would however have a problem with multiple CDRs being made and sold and/or distributed to a very large group of people. That can be very damaging not only to the band, but to any future reissue of the album. (Putting up MP3s of entire albums on the internet for potentially millions to download falls into the same category). Some people make the mistake of trying to lump all of these things together. Legally, they are all connected I suppose, but the amount of damage done to the artist is miles apart when one copy is made and when a million copies are made.

Although all of the above scenarios are technically illegal, we generally don't mind if it's kept under control (like one copy of an out of print CD for a friend).

Don, it hasn't been so much on this board that this topic has gotten out of control, but on the da-dl. Most of us agree, that by copying something that is "out of print", the only one you are hurting is the guy selling it for $40 on e-bay. Only one guy on the da-dl was trying to defend copying in print stuff. One of the good audiori bros did make the valid point in that discussion though that many who have a cd-r of something won't buy it when it finally does get re-issued. So, if and when that happens, or there are affordable copies of the original at this site, I'm sure you'll do the right thing. Wink

yeah, I plan on doing the right thing! I'm gonna buy up all the copies and sell them on ebay and then retire! Big Grin

Yes, I made CDR copies of my cassettes of Darn Floor, Outdoor Elvis and Let's Spin. I do plan on buying these when/if they ever get re-issued. I'd rather have the "real deal".

I have to admit that I’ve bought a few overpriced items off ebay. I was tired of waiting around for them to be re-released. I would of bought them from DA.com if they were here. But who knows when that will really happen? At least I’m all caught up now on all my TST related discs!

Unless I'm mistaken, I think that's a mangled quote of something we said on the DADL...

The argument being made by a few people on the list was that it was "ok" to pirate CDs if it wasn't something you would want to pay money for - which is a really weird thought. We said if you want it enough to own it, you want it enough to pay for it... If you don't want something, why would you take it, even if it was offered to you for free (illegally)?

After a nearly 5 month hiatus this thread has been resurrected?

Hmm.

I know some of the flaming going on is tounge in cheek. Some of it may not be.

But for those with the tongues firmly checked... anyone want to help me get a cd copy of Adam Again's _Homeboys_? I own it. I bought the cd years ago. But now I can't find it. I think a friend might have it but I don't know who that friend is and I've been unable to track it down. It's not sitting by my Perfecta cd nor by my Ten Songs or Dig cassettes (all original, yes). I recently bought the Adam Again 2000 tribute concert at Cornerstone and hearing a couple of those Homeboys songs made me go looking for it.

I would be willing to burn a concert for you for your troubles. I have a list I can send you. Email me off list if interested: popice@juno.com
